I'd use a booster. I don't think that photo shows a good fit with the seatbelt.

IMO we are talking about a 12yo not a 5/6/7yo. So yes I would let him ride without a booster.

The lap belt is too high up on his soft tummy. It should lie flat across the hips, closer to his thighs, and the shoulder belt is too close to his neck. Regardless of his age, I'd booster him with that belt fit.

OP-Your question was whether it is safe. The belt isn't positioned properly. So the answer is no, its not. The laws of physics don't give a ~POOP~ about his age. It sucks, it does. But if he's still in a booster in your car I don't get what the big deal is boostering him in another car where the seatbelt also doesn't fit right.
Carly-The Incognito is awesome! What a great compromise for older kiddos. I'll keep it in mind for my ODD.

12 year olds can still suffer from seat belt syndrome, especially ones under 4'9" with a poor fitting belt. A lap belt over the abdomen like that means a higher risk of internal and spinal injuries.

He isn't tall/big enough not to have it. I would make him use a booster. My son is 10.5 and no where close to not needing one.

That lap belt and the belt hitting his neck can cause serious injuries.

I have my 10yo unboostered, but he is 5ft tall and 100lbs (I grow giants) I think that incognito looks like a great option for your son. I had never seen it before and I'm actually thinking about it for my oldest now.

I need to say that in my sister's car there is no room to add a booster seat, I will likely order the thing carly linked as it might fit between dd's booster and yds's seat. she has a tiny car. Also he put the seat belt on himself and may be slouching a bit. I will have to have him sit again and see if he was. My dh took these pics. He has not gone anywhere in the car as of yet.

To your son, and she is still in a booster in our car. She is almost 11. The belt just doesn't fit right without. I have an older car, Oldsmobile. Now, she is allowed to ride in my SIL car without one. She has a Subaru, and the fit is much better. I actually just dropped the booster for my son who is 12 1/2. It was obvious the the booster was no longer needed. Anywho, I think your guy still needs a seat.

Love that Incognito! I could have REALLY used one of those for my DS last year (regular booster was making him too tall for the seatbelt but too small without (he's 4'9" now at 9 and 70lbs so now we're past that point).

He's at that age where it's almost-but-not-quite. And FWIW, my now-12-year-old did indeed sit in a booster seat for much of last year, though she could safely sit in my mother-in-law's vehicle without one. And we live in an area where most kids are in backless boosters by age two, because San Antonians hate their kids.

If he is likely to buckle himself and sit with a natural, slouched posture when he rides (presumably at 12 he is) then I would go with that fit when determining safety, not the absolutely optimal case.

Most of them absolutely do. I drive an itty bitty Chevy Cruze and have had to go through my fair share of backless boosters, for DS, because they were too wide, and would go over the belt buckle stalk (but his butt wouldn't).
