Default can he safely ride this way?

while my sister is here for the summer we are using her car a lot. Its a small hundai and ODS passes all the "tests" for riding without a booster seat. Not to mention he is almost 12. In our SUV his feet do not reach the floor yet so he is still in a booster. here are some pictures. Safe or not safe?

I don't love the lap belt fit (it's an case of "almost, but not quite), but for the time being, I do not believe he is incredibly unsafe, especially for his age. It's not as if we are talking about an 8 year old here.

My mom is 4'10" and the belt will never fit her the way it's supposed to, but due to age, she obviously has a more mature structure.

I hate when people say that. You're an adult and he is not. You obviously weigh more and like Brandi said, adults have more mature bone structure. If you don't want to use a booster, don't. The belt doesn't fit him quite right and I'd use a booster.

you would continue to booster a child that is about to turn 12? that is what I am getting at...where is the line drawn? I mean in 2 months he is legally allowed to sit in the front seat of a car???? He is my oldest child hence my guinea pig so to speak. I dont know when you stop boostering a child. He is mature enough, old enough (in my book) weighs plenty, 75 pounds at his last appt (we dont keep a scale in the house because I am obsessive). I just honestly dont know where the line is drawn at the safe age to say ok its safe now.

Its generally best to aim for 4'9" (in fact, that is law in some states). That's just an average though and it depends on the vehicle too.

FWIW, the smallest "adult" crash test dummy that must pass in a vehicle without a booster is 5'2". Adults have mature bone structures though. A 12 year old does not.

Although, to be perfectly honest, if I were under 5" and 120lbs, I'd totally be using an Incognito myself. I like my internal organs. Bram will be using an Incognito (or similar) for the rest of his life because he'll never reach 5".

I agree with Carly. It looks to me like the belt is across his stomach not his hips and it is too close to his neck. If he were mine, I'd use the incognito.

In Florida a 5 year can sit in the front seat. It's not about law but safety. And I realize I'm being bitchy, but why ask if your just going to argue about what people are telling you? We've said we think it's not safe. You asked for opinions. Opinions were given. Do with it what you will.
